Lewiston Man Charged With Rape in Valley County

COUNCIL, ID - A 41-year-old Lewiston man accused of having sex with a woman while she was unconscious will be arraigned in Valley County Fourth District Court later this month.  A preliminary hearing was held on Tuesday for Brad Lee Picard, Jr.

Picard was arrested on November 8th on a charge of Felony Rape-Victim Was Unconscious or Asleep, and posted a $20,000 bond.  His next hearing is January 29th in Council. 

According to an investigative report from the McCall Police Department, the alleged victim contacted an officer on August 8th to report that she had been sexually assaulted on January 29, 2017 while participating in a weekend gathering at a vacation rental in the 1500 block of Highline Drive in McCall. 

"Early in the morning on the 29th, [the woman] was found by several people in the residence in a bedroom with [Picard].  [The woman] was intoxicated and unconscious at the time," the report says.

Witnesses allegedly told police that they found Picard putting on his pants and the woman asleep in the bed, naked from the waist down.

"[She] did not know this occurred until she was told later in the morning about the incident," the police report adds.

Several witnesses reportedly told officials that Picard did not appear to be intoxicated, while Picard allegedly told police that he did not remember anything that happened at the residence due to being intoxicated.

"He remembered being at "some bar" in McCall.  The next thing he remembered was waking up in the morning," an officer says in the report.  "It should be noted none of the people I interviewed described Picard as being intoxicated to the point where he may have blacked out."

The woman was reportedly told later that Picard was taken out of the bedroom and he repeatedly stated, "I f***ed up."  The woman's "lifeless body" was taken to a different bedroom.

Later that afternoon, Picard allegedly told the woman, "What happens in McCall, stays in McCall."
